EmployForm Acceptable Use Policy

This Acceptable Use Policy (“AUP”) covers and governs each individual end-user’s (“you” or “your”) use and access to the EmployForm platform and services (the “Service”), owned and operated by EmployForm (“EmployForm,” “we,” “our,” or “us”). EmployForm’s Privacy Policy explains how we collect and use your personal information.

BY USING THE SERVICE, YOU ARE AGREEING TO USE THE SERVICE IN ACCORDANCE WITH THIS ACCEPTABLE USE POLICY, AND TO REVIEW OUR PRIVACY POLICY.

YOUR CONTENT & PERMISSIONS

When you use the Service, you provide us with things like your resume, application details, messages, and other related data (“Your Content”).

Your Content is yours. You represent that you have all necessary right, power, and authority to use the Service and share Your Content and will comply with all applicable laws and the policies of the employer to whom you are applying when doing so. This AUP does not give us any rights to Your Content except for the limited rights that enable us to provide the Service to you and the prospective employer.

SHARING AND MISUSE OF THE SERVICE

The Service is designed to facilitate legitimate employment applications. By using the Service, you agree to do so responsibly and to not misuse the Service or help or encourage anyone else to do so.

This includes, but is not limited to, not doing or trying to do any of the following in connection with the Service (or assisting, enabling, authorizing, or encouraging a third party to):

A. Prohibited Content

  • Store, transmit, or create libelous, obscene, deceptive, defamatory, pornographic, racist, sexual, hateful, unlawful, tortious, or otherwise objectionable content.
  • Upload any material that violates the intellectual property rights (including copyrights, trademarks, or patents) or privacy rights of any third party.
  • Submit content that is infringing, fraudulent, misleading, or intentionally inaccurate (e.g., submitting a false resume or educational credentials).
  • Upload or transmit any file containing viruses, Trojan horses, worms, spyware, or other such malicious code designed to damage or disrupt the Service or data.

B. Prohibited Conduct and System Abuse

  • Use or access the Service in a way that is not authorized or is prohibited by the policies, rules, or procedures of the prospective employer (e.g., submitting bulk or unsolicited applications).
  • Share your login, password, or other access credentials for the Service with any third party.
  • Harm, harass, threaten, or impersonate any person or violate the legal rights of any third party.
  • Probe, scan, or test the vulnerability of any EmployForm system or network.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems or networks.
  • Access, search, or create accounts for the Service by any means other than our publicly supported interfaces (for example, “scraping” or creating accounts in bulk).
  • Send unsolicited communications, promotions, or advertisements, or spam to other users or employers via the Service.
  • Modify, translate, adapt, merge, make derivative works of, disassemble, decompile, or reverse engineer any part of the Service except where expressly prohibited by applicable law.

YOUR RESPONSIBILITIES

  • You are responsible for your conduct and Your Content and your compliance with this AUP.
  • You must provide all necessary equipment and are responsible for all costs and expenses incurred by you when accessing the Service.
  • You agree to safeguard your password and keep your account information current and accurate.
  • You understand that EmployForm has the right, but not the obligation, to review your conduct and Your Content for compliance with this AUP and to remove content from the Service at any time and without notice. We are not responsible for the content people post and share via the Service.

OUR PROPERTY & RIGHTS

The Service, including its design, code, and user interface, is protected by copyright, trademark, and other applicable laws. This AUP does not grant you any right, title, or interest in the Service.

TERMINATION & RIGHT TO SUSPEND

You are free to stop using our Service at any time.

We reserve the right to suspend your access or end your use of the Service at any time at our sole discretion and without notice if you are not complying with this AUP, or are using the Service in a manner that may cause us legal liability, disrupt the Service, disrupt others’ use of the Service, or, in our opinion, cause harm. We may also remove Your Content under these circumstances.

NO WARRANTIES AND NO LIABILITY

As between EmployForm and you, we do not make any warranties (whether express or implied) about the Service. The Service is provided “as is” and any content downloaded or accessed from the Service is accessed at your own risk.

WE DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MODIFICATIONS

This is the most current version of the Acceptable Use Policy. We may revise the policy from time to time and will post the updated version with a new Effective Date.
