This California Privacy Notice (“CA Applicant Privacy Notice”) contains disclosures required by the California Consumer Privacy Act (“CCPA”) and applies only to California resident job applicants.
This Notice describes EmployForm‘s collection, use, and disclosure of personal information and sensitive personal information related to its job applicants, as well as your rights with respect to that information.
Scope of this Notice: This Notice applies to personal information that EmployForm collects about you as a job applicant. For information about how we treat data once you become an employee, please refer to our separate Employee Privacy Notice.

Personal Information We Collect and Disclose for a Business Purpose
In the past 12 months, we have collected and disclosed for a business purpose the following categories of personal information and sensitive personal information about California job applicants:

We do not “Sell” or “Share” (for cross-context behavioral advertising) the personal information or sensitive personal information of job applicants as those terms are defined under the CCPA/CPRA.
Categories Of Sources
We collect the above personal information from the following categories of sources:
- You, the Applicant: Through your direct submissions, resumes, cover letters, and communications.
- Recruitment Partners: External recruiters or job platforms (e.g., LinkedIn, Indeed) that submit your application.
- Background Check Agencies: Third-party providers used to verify information, subject to your authorization.
- References: Individuals you provide to us as professional references.
- Service Providers: Software providers that host our application portal and conduct assessments.
Why We Collect and Use California Applicant Information
We collect and disclose all categories of personal information for the following Business Purposes as identified in the CCPA:

Recipients Of California Applicant Personal Information
We disclose the categories of personal information listed above for the Business Purposes listed above to the following categories of third parties:
- Service Providers: Companies that provide critical business services like application hosting, IT support, background checking, and interview scheduling.
- Affiliates and Subsidiaries: Other entities within our corporate family for necessary processing related to your application.
- Professional Advisors: Auditors, lawyers, and consultants.
- Governmental/Regulatory Agencies: When required to comply with law or requested by government authorities (e.g., EEO reporting).
Your Rights Regarding Personal Information
If you are a California resident, you may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:
- Right to Know: You have the right to request that we disclose to you the categories and specific pieces of personal information we have collected, used, and disclosed about you.
- Right to Correct: You have the right to request the correction of inaccurate personal information we maintain about you.
- Right to Delete: You have the right to request the deletion of personal information we have collected from you, subject to certain exceptions (e.g., the information is necessary to comply with a legal obligation).
- Right to Limit Use and Disclosure of Sensitive Personal Information (SPI): We only use your SPI for purposes permitted by the CCPA/CPRA (e.g., performing the service you requested, legal compliance, security). Therefore, we do not offer a separate right to limit this use.
- Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising your privacy rights.

Verification Process
We will need to verify your identity before processing most requests to know or delete. We will require you to provide, at a minimum, your full name, email address, and phone number, and information about your prior application to help us match your identity to our records. If we cannot successfully verify your identity, we may not be able to fulfill your request.
Authorized Agent
You may designate an authorized agent to make a CCPA request on your behalf by providing the agent with written authorization or a power of attorney. We will require the agent to provide us with proof of this authorization before processing the request, and we may still require you to verify your own identity directly with us.
Changes to this CA Applicant Privacy Notice
We may change this Notice from time to time. If we make any changes, we will update the “Last Updated” date at the top of this page. We encourage you to visit this page periodically for the latest information on our applicant privacy practices.
